products including colored contact lens, clear contact lens, accessories and any other eyeglasses items available through the Site as "Products".

Before using any of the Services or purchasing any of the Products, please read these Terms of Service and any other terms, conditions, notices, policies, and agreements referenced and/or available by hyperlinks on the Site (the "Terms") , which contain rules and other guidelines related to your access, use and purchase of the Services and Products. This Terms of Service establishes a legal agreement between you and us. You hereby waive any applicable rights to require an original (non-electronic) signature or delivery or retention of non-electronic records, to the extent not prohibited under applicable law. If you do not agree to be bound by these Terms of Service, please do not access our Site or make any purchases through the Site.

We will use the Account Information and any additional information we may collect or obtain in connection with your use of our Site in accordance with our Privacy Policy. By accessing and/or using the Site and associated sites, you agree to be bound by these Terms, as updated by us from time to time. So your access to and use of the Services and purchase of the Products may be unauthorized if you do not agree to be bound by these Terms.

Any action or request made by any user of your Account or Access Tool will be deemed to have been made by you and the instruction will be carried out without further enquiry. We will not be liable for acting on an instruction. You must immediately notify us:

Any consultations provided to you will be provided by licensed optometrist, ophthalmologist, and/or other health care professional appropriately licensed and qualified to provide you health care services. If you experience any pain, symptoms, blurred vision, "seeing floaters" or other maladies of the eye, consult your physician immediately or call 911. The content of the Site, including without limitation any content accessed, sent or made available for use or download through the Site (inclusive of any information transmitted by third parties and/or healthcare providers and eyeglass prescriptions) does not constitute professional medical advice, diagnosis, or treatment by us of any kind. You should always seek the advice of your qualified healthcare professionals with any questions or concerns you may have regarding your individual needs and any medical conditions. We do not recommend or endorse any specific tests, healthcare providers, physicians, products, treatments, therapeutics, pharmaceuticals, devices, procedures, options or other information that may be included on, accessed through, sent through or made available for use or download through the Site.

Section 4 Prescription

At Sigocontacts, when placing an order that requires a prescription, you represent and warrant that the prescription details are valid and accurate as of the order date. You agree to provide us with a copy of your original prescription for verification to ensure that your purchase information exactly matches your ophthalmologist's prescription. It is your responsibility to use the correct type of prescription associated with the product you wish to purchase from us. If the prescription on the delivered product does not match, do not use the product and contact our LiveChat immediately. We are not responsible for problems caused by incorrect prescription information provided by you and by submitting a prescription you are agreeing to this clause.

Section 5 Products or Services

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return&Exchanges. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. (A) Sigocontacts WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND, UNDER ANY CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHER THEORY, INCLUDING DAMAGES FOR LOSS OF PROFITS, USE OR DATA, LOSS OF OTHER INTANGIBLES, LOSS OF SECURITY OF INFORMATION (INCLUDING UNAUTHORIZED INTERCEPTION BY THIRD PARTIES OF ANY INFORMATION), EVEN IF ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES;

(B) WITHOUT LIMITING THE FOREGOING, Sigocontacts WILL NOT BE LIABLE FOR DAMAGES OF ANY KIND RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR FROM ANY PRODUCTS OR THIRD PARTY MATERIALS, INCLUDING FROM ANY VIRUS THAT MAY BE TRANSMITTED IN CONNECTION THEREWITH;

(C) YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE SITE OR ANY PRODUCTS OR THIRD PARTY MATERIALS IS TO STOP USING THE SITE; AND

(D) THE MAXIMUM AGGREGATE LIABILITY OF Sigocontacts FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, SHALL BE THE GREATER OF (I) THE TOTAL AMOUNT, IF ANY, PAID BY YOU TO Sigocontacts TO USE THE SITE, AND (II) TEN U.S. DOLLARS ($10).

ALL LIMITATIONS OF LIABILITY OF ANY KIND (INCLUDING IN THIS SECTION AND ELSEWHERE IN THIS DOCUMENT) ARE MADE FOR THE BENEFIT OF BOTH Sigocontacts AND THE AFFILIATED ENTITIES, AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS.

Section 14 Indemnity

To the fullest extent permitted under applicable law, you agree to defend, indemnify and hold harmless Sigocontacts and the Affiliated Entities, and their respective successors and assigns, from and against all claims, liabilities, damages, judgments, awards, losses, costs, expenses and fees (including attorneys' fees) arising out of or relating to (a) your use of, or activities in connection with, the Site; and (b) any violation or alleged violation of this Terms of Service by you or your authorized users, or (c) in connection with your use of, or inability to use, our Site or your purchases or placement or transmission of any message or information on our Site by you or your authorized users or your violation of law or the rights of a third party.

Section 15 Termination

You agree that Sigocontacts may terminate your access to the Site without prior notice and for any reason, and you acknowledge and agree that we may immediately deactivate or delete your account and all related information and files in your account and bar any further access to such files or our Site. Further, you agree that we shall not be liable to you or any third party for any termination of your access to our Site and/or deactivation or deletion of your account. These Terms remain in effect even after your access or account is terminated. You also agree that any violation by you of these Terms will constitute an unlawful and unfair business practice, and will cause irreparable harm to Sigocontacts, for which monetary damages would be inadequate, and you consent to us obtaining any injunctive or equitable relief that Sigocontacts deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies we may have at law or in equity.

Section 16 Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Section 17 Miscellaneous

We will not be liable for a failure in the performance of obligations under these Terms by reason of strikes, riots, fire, explosions, acts of God, epidemics or pandemics, war, governmental action or direction, telecommunications or internet outages or any other cause which is beyond our reasonable control.

The Site may be accessed throughout the United States of America and overseas. We make no representations that the content or the Site complies with the laws of any country or region outside the U.S.. If you access the Site from outside the U.S., you do so at your own risk and are responsible for complying with the laws in the place where you access the Site.

This Terms of Service does not create any partnership, joint venture, employer-employee, agency or franchisor-franchisee relationship between you and Sigocontacts. If any term herein is found to be unenforceable for any reason, that term will be considered separable from this Terms of Service and will not affect the enforceability of any other term.

You may not assign, transfer or sublicense any of your rights or obligations under this Agreement. We may assign, transfer or sublicense any or all of our rights or obligations under this Terms of Service without restriction. Neither party's waiver of any breach under this Terms of Service will be considered a waiver of any earlier or later breach.

Any headings in this Terms of Service are for convenience only. The term "including" and its variations will be interpreted as if followed by the phrase "without limitation". This Terms of Service, including any incorporated terms, is the entire agreement between you and Sigocontacts relating to its subject matter, and supersedes any earlier or contemporaneous agreements or understandings between you and Sigocontacts relating to that subject matter. Notices to you may be made by posting to the Site or by e-mail, or by regular mail. Sigocontacts will not be responsible for any failure to fulfill any obligation due to any cause beyond its control.

It is our desire and pleasure to hear from our customers and welcome your comments regarding our Services, Products, including our Site. We request that you be specific in your comments on our Services and Products. If you send us comments, suggestions, ideas, materials, notes, drawings, concepts, or other information (collectively as "Feedback"), the Feedback shall be deemed, and shall remain, our property.
